When you visit Jammboree.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

No part of this website may be copied, altered, or updated. All other logos and company name(s) mentioned in this website are trademarks of their respective owners.

Your membership account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or legal guardian. Jammboree.com reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

Risk of loss

All items purchased from Jammboree.com are made pursuant to a shipping contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier.

Jammboree.com will attempt to be as accurate as possible with the product descriptions. However, Jammboree.com does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. If a product offered by Jammboree.com itself is not as described, your sole remedy is to contact us to discuss the situation and determine the best outcome.

Applicable law

Disputes

Any dispute relating in any way to your visit to Jammboree.com or to products you purchase through Jammboree.com shall be submitted to confidential arbitration in the appropriate jurisdiction, except that, to the extent you have in any manner violated or threatened to violate Jammboree.com intellectual property rights, Jammboree.com may seek injunctive or other appropriate relief in any state, federal or national court in the relevant jurisdiction, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the relevant jurisdiction. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Site policies, modification and severability

Please carefully review our other policies, such as our Shipping and Returns policy, posted on this site. These policies also govern your visit to Jammboree.com. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall to be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Delivery

Jammboree.com operates multiple warehouses around the globe. Occasionally we may ship orders to US customers from warehouses outside of the USA. In this event, the customer will still receive a clean delivery with no duties or taxes payable by the customer.

Where an incorrect address has been given to Jammboree International with the order, we reserve the right to charge for any extra carriage costs incurred.

All items are subject to stock availability. 

Sales tax is also charged on all shipping charges for orders delivered in Illinois, Georgia, California, Colorado and Texas. 

Pricing

While we take every measure to ensure the prices on our website are as accurate as possible, we reserve the right to change a price in exceptional circumstances. If a price is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to cancel the order.

If an order is placed for an item with an erroneous price, and the erroneous price is less than the cost price of the item, we reserve the right to offer to process the order at cost price or the opportunity for the customer to cancel the order.

Prices on orders for out-of-stock or pre-release items are valid for one week after the order is placed. If the price changes when stock becomes available customers will be informed of the change before payment is processed and offered the opportunity to cancel the order.

Jammboree.com will honor requests for credits on price drops that occur within 5 working days of the original invoice date. Price drops beyond this date will not be matched. 

In the event of payment default, the customer will be responsible for all of Jammboree.com’s cost of collection, included but not limited to court costs, filing fees and attorney fees.

Business Customers

If you are a business customer or if the goods are used wholly or in part for business purposes, we shall not be liable to you for any business loss including loss of profits, (whether direct or indirect) data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods.

If you have a credit account with us, payment is due 30 days after the date of our invoice and we may charge interest for late payment. If the customer is late in payments, Jammboree.com reserves the right to suspend shipments until payment is received.

General

We reserve the right to decline any order for any reason. Jammboree.com cannot accept credit cards issued outside of the USA, Canada or Mexico.

The above policies are part of our commitment to high quality service. They do not affect your statutory rights as a consumer.
